Terms of Sales

  1. Responsibility

    1. The responsibilities of Côte & Mer are governed by laws n ° 66-420 of 06/18/66 , n ° 67-5 of 01/3/67 and decree n ° 66-1078 of 12/30/66 . They cannot be incurred in the event of cancellation of departures or modification of schedules due to influx of passengers, weather conditions, damage or for any other case of force majeure, fortuitous or otherwise.

    2. To this end, Côte & Mer will suggest to the passenger to postpone the said service to a later date or to reimburse it. Côte & Mer declines all responsibility for direct or indirect costs and damages caused by these modifications.

    3. In uncertain weather conditions, it is recommended to have the timetables confirmed.

    4. The quality of the service as well as the beauty of the landscapes and the seabed are linked to the weather conditions. Likewise, concerning animal observations, these are wild animals in their natural environment, Côte & Mer cannot in any way be held responsible for a possible absence of fauna or the quality of observation.

  2. Baording

    1. All passengers, including those traveling for free, excluding children under one year of age, must be in possession of a transport ticket.

    2. A minimum of 6 passengers is required to ensure the departure of the rides to Les Sables D'Olonne or to Ile de Ré. A minimum of 7 passengers is required for the shuttle to Ile de Ré.

    3. Passengers must present themselves in front of the boarding area 15 minutes before departure.

    4. No refund may be required if the passenger shows up late for boarding.

    5. The duration of the outings is given as an indication and may vary depending on the transport conditions.

    6. Passengers are informed of delays or postponements, as far as possible, as quickly as possible.

    7. Passengers are equipped with an approved self-inflating life jacket, supplied by Côte & Mer, its wearing is compulsory. Passengers are equipped on the quay before boarding. Passengers must respect the safety instructions recommended by the crew.

    8. Hand baggage (for example a small backpack) is allowed on board to easily transport personal effects.

    9. Animals are not, in principle, allowed on board (unless otherwise agreed).

    10. Furthermore, Côte & Mer declines all responsibility for damage of any kind that may affect the effects, objects or equipment on board its boats. It is up to the owners to ensure its safekeeping, protection or safeguard.

    11. Likewise, it is advisable to wear warm and windproof clothes, not afraid of sea water.

    12. If nuisance caused by passengers impedes the proper functioning of the boat, a declaration will be made to the competent authorities for hindering the proper functioning and endangering others. The same goes for non-compliance with safety instructions given by the crew as well as behavior considered dangerous.

    13. Côte & Mer reserves the right to disembark any person behaving aggressively or in a state of intoxication, without consideration or compensation.

    14. In the event of the observation of damage to the boat, intentional or following the negligence of the passenger, the latter will be responsible for paying the costs relating to the restoration of the goods.

  3. Schedule

    1. The schedules are random and depend on the schedules and tidal coefficients, changing every day. ​

  4. Disabled

    1. The equipment we make available to you has its limits, people with reduced mobility can be accommodated on board, subject to being able to embark with an accompanying person, and being able to sit on a seat on the boat.

    2. On some of our boats, boarding a wheelchair is possible on condition that prior notice is given, and that it is organized in such a way that the passenger and his wheelchair can be boarded separately.

    3. In addition, Côte & Mer  cannot be held responsible for non-compliance with the accessibility of people with reduced mobility of land installations (pontoons, docks, etc.).

    4. The pilots and guides are at the disposal of the passengers to facilitate their embarkation and disembarkation operations.

  5. Individual reservations

    1. Reservations are imperative.

    2. It is strongly recommended to book in advance. Reservations are free, and can be made by phone, email, at the numbers and addresses indicated on our documents (website, leaflet, etc.), as well as at the reseller service providers. The reservation is made against payment (deposit or full).

    3. The tickets are valid for the season of the current year and any claim must be made before the end of the current year. Passengers can reschedule their tickets depending on availability and at least 3 days before the scheduled departure. In any case, if it is possible, the modification of reservations is free within the limit of available places.

  6. Group reservations & privatization

    1. In some cases, for established groups, it is possible to privatize the  boat  for tailor-made services. The privatization of the boat includes the qualified crew necessary for navigation as well as the safety of passengers.

    2. A "group" reservation is made up of paying people in total.

    3. These reservations are subject to the following conditions:

      1. Group booking conditions

        1. Reservations must be made by email and / or post. Côte & Mer will confirm the reservation by indicating an end date of the option, on which date a deposit of 35% of the total amount of the reservation must then be paid. The said reservation will be considered final. If the deposit is not paid on the option end date, the reservation may be canceled. The balance of the amount of the trip must be paid before the date of departure.

      2. Cancellation conditions for groups

        1. 30 to 15 days before departure: 35% charge on the amount invoiced

        2. 14 to 7 days before departure: 50% charge on the amount invoiced

        3. Less than 7 days before departure: 100% charge on the amount invoiced ​

      3. Modifications by customer groups ​​

        1. ​ Any modification by the customer of his group reservation occurring up to seven (7) working days before the date of departure will be free.

        2. Any modification by the customer of his group reservation occurring within the period of seven working days before the day of departure will be invoiced at 75%. Any withdrawal on the day of departure will be considered as a no-show and will therefore be invoiced in full (100%)

  7. Nice present

    1. The Gift Voucher is considered as a means of payment, it allows the issuance of a transport ticket. The use of a Gift Voucher is subject to prior reservation by the beneficiary.

    2. The validity of the Gift Voucher is that indicated on the Gift Voucher itself. The Gift Voucher is non-refundable, but it remains transferable to another beneficiary.

  8. Prices

    1. The sale price is expressed in euros all taxes included.

    2. The prices indicated are subject to changes in taxation and various taxes during the season.

    3. Child rate is applied for children under 16  years.

  9. Means of payment

    1. Côte & Mer accepts payments in cash, by credit card, by check and ANCV holiday vouchers.

    2. Transfers can be accepted on condition of payment prior to the service.

    3. Payments on the day of the service, of the reservation, upon receipt of the invoice. For Companies, payment within 30 days, on the date of receipt of the invoice.

  10. Withdrawal of tickets

    1. Tickets are collected at the ticket office  when boarding the boat or can, at the passenger's request, be sent to him by regular post.

    2. The withdrawal of tickets will only be possible with payment of the full price of the service.

  11. Refund

    1. Tickets are refunded in the event of force majeure requiring the cancellation of the service. In the event of cancellation of the service by Côte & Mer , the entire reservation will be refunded.

    2. In the event of cancellation by the customer, at the latest two days before the date of departure, or in the event of a no-show, Côte & Mer will keep the sums paid.

    3. Any request for reimbursement for medical reasons must be accompanied by proof must be sent, within 15 days of departure, to Côte & Mer .

  12. Disputes

    1. The transport contracts governed by these general conditions are subject to French law and only the French language is recognized for any document provided by the parties in the context of a dispute or legal action.

    2. If a dispute arises concerning the interpretation or the execution of the transport which cannot be settled amicably within six months from the first legal act between the Parties hereto, they attribute jurisdiction to the Commercial Court of La Roche sur Yon.
